Wedding Photography Terms of Business

A Retainer Fee of £250 is payable to secure your date, which will be deducted from your total balance. The remaining balance is then payable 14 days before the wedding. Upon payment of the Retainer Fee, Clive Blair Photography will reserve the event date on behalf of the Client(s) and reject all other requests for event coverage on that date. Thus, if for any reason the wedding is cancelled or postponed, all monies paid are non-refundable or non-transferable to a new date. To reserve a new date a new Retainer Fee will be required at the current rate.

The Client (the one signing this booking form) may cancel this contract anytime after it has been signed by sending written notice to Clive Blair Photography. If the written notification is received more than 120 days before the date the wedding is due to take place then Clive Blair Photography will reimburse the Client any monies paid, except for the Retainer Fee.

If the written notice of cancellation is received within 120 days of the due wedding date then the amount of the price that Clive Blair Photography shall be entitled to is calculated in accordance with the table below (detailing the amount Clive Blair Photography is entitled to):
0-7 days – 100%
8-14 days – 95%
15-30 days – 90%
31-60 days – 80%
61-120 days – 50%
more than 120 days – 0%

Clive Blair Photography will work solely with the Bride and Groom, or someone designated by the Client as their representative, when it comes to any photography requests, ordering, proofing, and shipping of final products.

Clive Blair Photography reserves the right to refuse to offer services or products due to non-payment.

While every reasonable effort will be made to produce and deliver the agreed photographs of the event, the photographer’s entire liability to the Clients for any claim arising from the photographer’s performance or agents and servants (including photographers, processing laboratories and postal and delivery agents ) is limited to a refund to the Clients of the amount paid for services. The primary photographer for the wedding will be Clive Blair. If the photographer is involved in an event rendering him unconscious, liability is limited to a full refund of monies paid. In the unlikely event of personal illness, Acts of God, or other circumstances beyond the control of the photographer, a substitute photographer of high qualifications may be sent to fulfil the obligations of the photographer herein contracted. If a substitute photographer is provided, the Client has the right to refuse to accept the substitute photographer and may instead terminate this agreement and receive a full refund of all monies paid. It should be noted that since shooting his first wedding in Aug 1987 Clive Blair has never missed an event or wedding.

Re-order print prices are those ruling at the time of placing the order.

Payment for re-orders is required at the time of placing the order.

Sizes quoted are approximate. We will provide a pleasing colour balance but cannot guarantee exact colour matching. Owing to anomalous reflectance caused by a combination of certain dyes and materials, especially man made fibres, it is sometimes impossible to record on film/digital media the exact colour of materials as seen by the human eye.

During a wedding your photographer will automatically re-take any photograph where they have seen that someone has blinked, but it is impossible to guarantee to see them all. The more people in the photograph the more difficult it is to see everyone.

The photographer will endeavour to take all the photographs agreed. However, because a wedding is an uncontrolled event, the photographer cannot guarantee delivery of any specifically requested image(s), especially if timings or events are altered without our knowledge or there are restrictions in place at any venue which would limit the photographers ability to provide their usual service. Clive Blair Photography will not be liable for loss of or interference with the photography due to restrictions on the location, including but not limited to, interference from surrounding devices, other people access limitations, flash restrictions, and the like.

If the photographer is exposed to (i) unsafe conditions, or (ii) objectionable or illegal acts at the event, the photographer reserves the right to take reasonable action to remedy such a situation, including but not limited to leaving the event. In such event, the photographer shall not be obligated to refund any of the fees paid by client because of such action.

If time and conditions allow, the photographer may take some candid photographs. Candid shots attempt to capture the atmosphere and spontaneity of the day, rather than achieve perfect lighting and background etc.

It is understood that the Client is hiring Clive Blair Photography for their technical and artistic expertise and, therefore, Clive Blair Photography reserves the right to shoot, edit and proof at their discretion. This means not all the photographs taken will be submitted, the final selection of prints submitted will be entirely at our discretion and all digital files will be provided in the JPEG format. Files in the RAW format will not be supplied and are unavailable for purchase.

Once a set of high resolution digital files have been provided the responsibility to preserve the images passes to the purchaser, and the decision whether to keep a copy in our files or not will be entirely at our discretion.

The 1988 Copyright Act assigns the copyright to the photographer. It is contrary to the Act and strictly illegal to copy or allow to be copied, any photographs covered by this contract. Limited reproduction rights of digital files will be made available for the client for personal use only (eg. wall hangings at home, social media). But any sale or publication for profit without the photographer’s express written permission is a violation of copyright laws.

The photographer reserves the right to use any image produced under this contract for display, promotional and any other purposes, solely for Clive Blair Photography.

The prices for album(s) orders are dependant on the selection of pictures for the album(s) being chosen no more than 6 months after the wedding date. If the final selection is late in being returned, Clive Blair Photography reserves the right to choose the final images for the album. If there is any reason to believe the final print selection will be unavoidably late, this must be discussed with Clive Blair Photography, who may be able to extend the date for the album selection to be returned.

This contract represents the parties’ entire agreement on this matter, superseding all other negotiations or agreements whether oral or written made before, during or after it’s execution. Any amendments to this agreement shall only be effective if made in writing that is executed by both parties hereto.

The laws of the United Kingdom shall govern, construe and enforce all of the rights and duties of the parties arising from or relating in any way to the subject matter of this contract.

Any action, proceeding or litigation relating to or arising from this agreement shall be brought in the United Kingdom.
